California Judge Orders Twitch Bot Maker to Give Up Sites, Shut Down Services
The programmer of a bot that unnaturally inflates Twitch viewer counts has had his business shut down past a California judge.
There are plenty of Twitching bots that can be utilized by streamers to inflate their views and followers counts. One of those was written by developer Justin Dr. Johnson. He was unrivaled seven of seven developers sued by Twitch, who alleged that the bots were damaging the Twitch user experience and brand, as they "make it harder for Twitch users to discover legitimate broadcasters and for those broadcasters to succeed."
Compounding the issue was Johnson's use of the word "Vellication" in his website URLs and social media accounts promoting the bot, which Twitch said could mislead users into thinking that the streaming site had supported them. In the suit, Twitch questionable cybersquatting, fraud, interference with contract, trademark infraction, unfair competition, and violations of two electronic computer fraud and insult acts.
Beth Labson Freeman, a judge on the USA Territorial dominion Tribunal for the Yankee District of California, ruled for Squeeze in the matter. The judge ordered that Johnson must not only disable his avail, but atomic number 2 must also turn over control of his domain names and social media accounts to Twitch likewise.
In the official order, the justice wrote, "Defendant will transfer the domain name calling twitchstarter.com and twitchstarter.goggle bo to Squeeze and will permanently disable the services previously offered at the websites associated with those arena names Defendant will not attempt to atomic number 75-registry these domain names OR register any other domain names that admit the discussion 'tweet' or any confusingly like-minded word(s)."
